This website is for informational purposes only. All content, including project details, specifications, visuals and descriptions, is illustrative and does not constitute a legal offer or binding agreement.

3. Intellectual Property

All materials, content, designs, and trademarks on this website are the property of SAARK BUILDCON LLP. Unauthorized use, reproduction, or distribution is strictly prohibited.

4. Disclaimer

Project renderings, images, specifications and timelines are indicative in nature and subject to change without prior notice. The promoter reserves the right to modify plans, layouts, specifications and project details as permitted by applicable law.

5. Limitation of Liability

SAARK BUILDCON LLP shall not be liable for any loss or damage arising from reliance on information provided on this website.

Project Booking & Property Terms – Samaya Antarvan

6. Nature of Booking

Booking of any unit in “Samaya Antarvan” constitutes a provisional application only. It does not create any right, title, lien, or interest in the property until formal execution of the Agreement to Sale and compliance with all required payments and documentation.

The promoter reserves the right to accept, reject, or cancel any application at its sole discretion. In case of rejection due to cancellation of the proposed project by the promoter, amounts paid shall be refunded without interest.

7. Registration & Statutory Charges

Registration charges, stamp duty, GST, statutory taxes, local authority charges, water, electricity, maintenance deposits and any other incidental expenses shall be borne solely by the Applicant(s).

8. Mode of Payments

All payments must be made directly in favour of the promoter through approved banking channels (Demand Draft, Cheque, NEFT, RTGS, etc.). The promoter shall not be responsible for any payment made to agents, brokers, or third parties.

9. Execution of Allotment & Agreement

Issuance of booking letters or allotment letters shall not confer ownership rights until execution of formal agreements and realization of the required payment percentage as determined by the promoter.

10. Delayed Payments

Delayed payments may attract interest at the rate of 15% per annum for the period of delay. A grace period of up to 30 days may be granted at the promoter’s discretion. Failure to clear dues within this period may result in cancellation.

11. Loans

Sanction of housing or plot loans is solely the responsibility of the Applicant(s). The promoter shall not be liable for loan rejections or delays. Payment obligations remain independent of loan approval.

12. Cancellation & Refund Policy

In case of cancellation (except where the project itself is cancelled by the promoter), cancellation charges equivalent to 10% of the total paid amount shall be deducted. Refunds shall be processed only upon rebooking of the same unit by another purchaser and completion of formalities.

13. Additions & Alterations

Structural modifications, amalgamation or subdivision of plots/units, changes in electrical, water or drainage lines, or alterations to approved plans shall not be permitted without written approval from the promoter and relevant authorities.

14. Possession & Maintenance

Possession shall be granted upon full payment of dues and execution of required conveyance documents. The Applicant(s) must take possession within 15 days of notice and maintain the unit in good condition at their own cost.

15. Promoter Rights

The promoter reserves exclusive rights to modify, revise, expand, merge, subdivide or alter project plans, specifications and common areas as permitted by applicable law. Such changes shall be binding upon all applicants and members.

16. Governing Law

These terms shall be governed by the laws of India. All disputes shall fall under the exclusive jurisdiction of the courts in Ahmedabad, Gujarat.
